On March 13, 2023, Bellingham City Council gave final approval to an ordinance that requires 120 days advance notice before any rent increases for residential units. This new requirement applies only to properties located within the city limits of Bellingham. The ordinance takes effect March 28, 2023.
Currently, State law only requires 60 days’ notice. The State Legislature was considering several rent–control bills this session, but these proposed laws have not yet passed. The City of Bellingham’s passage of the 120–day notice requirement is a good reminder that localities can impose tighter restrictions than what State law provides. It is therefore essential that landlords check local rules before taking any type of legal action with a tenant.
